REPORT OF THE REGULAR MEETING OF GORHAM TOWN COUNCIL

August 7, 2001

        The meeting was opened with the Pledge of Allegiance to the Flag.

Roll Call of Council:  Present:  Chairman Loveitt; Councilors Hamblen, Robinson, Phinney, Willett and Justice;  the Town Manager and the Town Clerk.
                                Absent:  Councilor Chicoine
        Moved by Councilor Justice, seconded by Councilor Willett and VOTED to approve the Minutes of the July 17, 2001 Regular meeting.  6 yeas.

There were no open public communications.   

Councilor Justice reported that the Ordinance Committee has met twice recently and at those meetings worked on several ordinance changes, some of which will be on the September agenda.  They also started a review of the Land Use and Development Code.

Councilor Willett congratulated Councilor Justice on being elected as Chairman of the RWS Board of Directors.

Councilor Robinson thanks Mike McGovern and Carolyn Vail for the help they gave him recently on research regarding a swimming pool

Chairman Loveitt congratulated Councilor Justice and Public Works Director, Gary Lorfano, on their election as Chairman  and Treasurer of the RWS Board.  He also reported on a successful fun day held last Friday by the Library.

The Town Manager reported that he, Chairman Loveitt and Town Planner Deb Fossum had recently met with officials from DEP and Scarborough regarding transportation issues in the area.  He also reported that the traffic light project in the center of town is just about completed with the crosswalks to be installed this week; that the Lazy Days of Summer held by the Library raised over $2100.00; and that the Town Clerk’s office has been approved for passports and will begin the process passports September 1, 2001.

The meeting recessed for a public hearing regarding an application for a Special Amusement Permit in the name of William E. Bodwell, II d/b/a Sierra’s at 2 School Street, Gorham.  There was no public comment and the hearing closed at 7:15 p.m.

Item #6517.  Moved by Councilor Phinney, seconded by Councilor Robinson and ORDERED that the Town Council authorize the issuance of a Special Amusement Permit in the name of William E. Bodwell, II, d/b/a Sierra’s.  6 yeas.

The meeting recessed for a public hearing regarding an application by William E. Bodwell, II d/b/a Sierra’s for a permit for five (5) coin operated amusement devices.  There was no public comment and the hearing closed at 7:35 p.m.

Item #6518.  Moved by Councilor Phinney, seconded by Councilor Robinson and ORDERED that the Town Council authorize the issuance of a Coin Operated Amusement Device Permit for five (5)  devices to William E. Bodwell, II d/b/a Sierra’s.  6 yeas.

Item  #6519.   The order, as read aloud by the Clerk, was moved by Councilor Phinney and seconded by Councilor Hamblen.  Moved by Councilor Justice, seconded by Councilor Hamblen and VOTED to change the word “accept” to “receive”.  6 yeas.

The order, as amended, was then voted resulting in the following:

ORDERED that the Town Council receive the Feasibility Study on Shaw School by Gawron Architects.  6 yeas.

Item #6520.  The order, as read aloud by the Clerk, was moved by Councilor Phinney and seconded by Councilor Willett.  Moved by Councilor Justice, seconded by Councilor Hamblen and VOTED to amend the proposed order by deleting sentence #4.  6 yeas.

Moved by Councilor Willett, seconded by Councilor Justice and VOTED to further amend the proposed order by deleting the School Committee recommendation.  6 yeas.

The order to set an advisory referendum on the question of building a swimming pool, as amended, then FAILED OF PASSAGE.        1 yea.  5 nays (Hamblen, Robinson, Phinney, Loveitt and Justice).
Moved by Councilor Phinney,  seconded by Councilor Robinson and VOTED to adjourn.  6 yeas.  Time of adjournment  - 9:50 p.m.
